Many employers rightly wish that their employees would not discuss their wage information with each other. Some even have policies against practices. As this article explains, several states have begun to enact laws forbidding employers from prohibiting employees from discussing their pay with each other. Regardless of any state law, employers–even non-unionionzed ones–should be mindful of Section 7 of the National Labor Relations Act, which states: “Employees shall have the right to self-organization, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection …” We discussed this issue with the Houston Chronicle earlier this year in an article entitled “Boss Can’t Keep Workers From Comparing Paychecks.”
