In April 2019, Mark Oberti and Ed Sullivan tried a breach of contract case in front of Judge Michael Gomez of the 129th Judicial District, Harris County. In the case, Miles Hyman, a former employee of KD Resources, LLC, alleged that he had a written severance contract signed by the President of KD Resources that provided he would receive 5-years pay (which, he alleged translated to $1 million) if he was terminated without cause. Hyman alleged that, shortly after that contract was executed, he was terminated without cause. Hyman filed a lawsuit against KD Resources in 2012. Oberti Sullivan LLP represented KD Resources. After substantial discovery, and numerous continuances, the case was tried to Judge Gomez in April 2019. On October 30, 2019, Judge Gomez entered a Final Judgment in KD Resources’ favor, ordering that Hyman taking nothing by his lawsuit.
