SMS TERMS OF SERVICE (Effective 9/25/2026)
These SMS Terms of Service govern SMS and MMS communications sent by Oberti Sullivan LLP (the “Firm”) to existing clients who have consented to receive text messages from the Firm. These Terms supplement, and do not replace or modify, the Firm’s written engagement agreement with a client.
Client-Related Messages Only
The Firm uses SMS only for occasional, one-to-one, client-related communications concerning an existing legal representation. Messages may include requests for information or documents, scheduling or appointment reminders, follow-up communications, notice that a document or email has been sent, and other matter-related or administrative communications. The Firm does not use this SMS service for advertising, promotions, solicitation, mass marketing, or spam.
Consent
The Firm sends outbound SMS messages only to clients who have consented to receive them. Consent may be provided in a signed engagement agreement or through other express oral or written consent. If a client initiates an SMS conversation with the Firm, the Firm also may respond within that conversation as appropriate. Providing a mobile telephone number through the Firm’s website or intake process does not, by itself, constitute consent to receive SMS messages.
Consent to receive SMS messages is not a condition of the Firm’s representation. A client may decline or withdraw SMS consent and continue to communicate with the Firm through other appropriate channels.
Message Frequency
Messaging frequency varies based on the needs of the client’s legal matter and the client’s communications with the Firm. The Firm does not operate a recurring marketing or promotional text-message program, and messages are generally sent only as circumstances relating to the representation warrant.
Message and Data Rates
Message and data rates may apply according to the client’s wireless carrier and service plan. The Firm is not responsible for charges imposed by a wireless carrier.
Opting Out
A client may opt out of SMS communications at any time by replying STOP to a Firm text message or by otherwise clearly telling the Firm that the client no longer wishes to receive text messages. The Firm will honor an opt-out request and will use other appropriate communication methods. After an opt-out request is processed, the Firm may send a single non-promotional confirmation that the client has been opted out.

Privacy
The Firm handles information associated with SMS communications in accordance with its Privacy Policy, available at https://osattorneys.com/privacy. No mobile opt-in information or text-message consent will be shared with third parties or affiliates for their own marketing or promotional purposes. Communications and telecommunications service providers may process mobile numbers, message content, and related data solely as necessary to transmit and manage SMS communications for the Firm.
Security, Delivery, and Time-Sensitive Communications
SMS messages may not be encrypted end-to-end, may appear on a device lock screen, and may be viewed by anyone with access to the receiving device or account. Clients should not use SMS to transmit Social Security numbers, account credentials, or similarly sensitive information unless the Firm specifically requests that method of communication. Clients should promptly notify the Firm if a mobile number is shared, changed, reassigned, lost, or compromised.
SMS delivery depends on wireless carriers, networks, devices, and other systems outside the Firm’s control and is not guaranteed. Clients should not rely solely on SMS for emergencies, filing or response deadlines, formal service, or any communication requiring confirmed or immediate delivery. When prompt confirmation is important, the client should call the Firm or use another agreed communication method.
Changes to These Terms
The Firm may revise these SMS Terms of Service from time to time. The Effective Date above identifies the most recent version. A revised version becomes effective when posted unless it states otherwise.
